FMC update for Crystal Cruises passengers on refund process

The US Federal Maritime Commission confirmed Crystal Cruises' filing of a petition for assignment for the benefit of creditors.

As previously detailed here, the company has ceased to operate and the assignee (liquidator) is Michael Moecker & Associates. The case was filed in Florida state court in Miami-Dade County on Feb. 11.

Crystal maintains an escrow account in compliance with FMC regulations for the purpose of refunding passenger fares and deposits for cruises departing from a US port. This applies only to cruises embarking in the US and does not provide reimbursement air travel, shoreside hotel expenses and other expenses outside of water transportation.

Escrow claims process yet to be established

The FMC said an escrow claims process has yet to be established by the assignee and its escrow agent, and there is no mandated deadline for initiating the claims process or when refunds will be disbursed from escrow to eligible passengers. The commission has no role in establishing the escrow claims process but said it will issue an updated advisory notice once it is advised of the claims process.

Meanwhile, the FMC continued to advise passengers seeking refunds to place a claim with their credit card issuer if they paid by credit card or their insurer if third-party travel insurance was obtained for a Crystal cruise.
